RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, INDEMINITY AGREEMENT, PROMOTION, ADVERTISING, REFUND, & CANCELLATION POLICY
I understand the nature of the www.coolvirginiasteppers.com, Cool Virginia Steppers, and Cool Ventures Entertainment Event/Activity, which may have risks and hazards known and unknown that may result in serious injury to me, including death, caused by the actions or inactions of me or by others, the conditions in which the Event/Activity takes place, and my negligence and the negligence of others. I represent that my participation in the Event/Activity has been approved by my physician and that I am dressed in comfortable and appropriate clothing and shoes. I acknowledge that if I believe that the Event/Activity conditions are unsafe, I will immediately discontinue my participation in the Event/Activity. Due to the presence of alcoholic beverages at the Event/Activity, I represent that I am of legal age to drink in all states of the USA. I agree to make plans prior to consuming alcoholic beverages to provide for a designated driver, alternative transportation from the Event/Activity, or obtain a hotel room to ensure that I will not operate a vehicle under the influence of alcohol. I agree to drink responsibly. In view of www.coolvirginiasteppers.com, Cool Virginia Steppers, and Cool Ventures Entertainment’s provision of equipment, facilities, and/o funds, and as a condition of my participation in this Event/Activity, I fully accept and assume responsibility and liability for injury (including death) that I may cause to others as a result of my participation and in connection with the Event. I further agree to assume all such risks and all responsibility for losses, including theft or damage to my property or the property of others, costs, medical expenses, and damages I incur as a result of my participation in the Event/Activity and in connection with the Event/Activity. I agree now and in the future to release, discharge, and indemnify the following “RELEASES”: www.coolvirginiasteppers.com, Cool Virginia Steppers, and Cool Ventures Entertainment, its officers, directors, employees (whether or not acting in the scope of their employment), staff, instructors, representatives, agents, sponsors, advertisers, owners and lessons of premises, owners or lessors of transportation carriers on which the Event/Activity takes place, from all liability, claims, demands, losses, expenses, costs, including attorney fees regardless of whether they may be wholly or partly negligent or otherwise at fault (including negligent rescue operations) and/or whether I am alleged to be negligent or at fault, including claims or liability relating to the injury of others. I further agree that if, despite this release, waiver of liability, and assumption of risk, I, or anyone on my behalf, makes a claim against the above names “RELEASES,” I will indemnify, save, and hold harmless each of above names “RELEASES” from any loss, liability, damage, or cost which may incur as the result of such claim.
PROMOTION AND ADVERTISING
I agree that all photographs, videotapes, and audio recordings of my participation in the Cool Virginia Steppers, www.coolvirginiasteppers.com, and Cool Ventures Entertainment Event/Activity are the property of Cool Virginia Steppers, www.coolvirginiasteppers.com, and Cool Ventures Entertainment and can be used by Cool Virginia Steppers, www.coolvirginiasteppers.com, and Cool Ventures Entertainment for promotion, advertising, and/or sales and are not subject to any royalty fees or payments to me now or at any time in the future.
RIGHT OF REFUSAL
www.coolviarginiasteppers.com, Cool Ventures Entertainment, and Cool Virginia Steppers reserve the right to refuse to provide products and services and deny entry or participation of an individual relating to any www.coolvirginiasteppers.com, Cool Ventures Entertainment, and Cool Virginia Steppers Event or Activity.
REFUND, EXCHANGE, AND CANCELLATION POLICY
No Refund or Exchange on customer purchases unless Event/Activity is canceled by Cool Ventures Entertainment, Cool Virginia Steppers, and www.coolvirginiasteppers.com. Cool Ventures Entertainment, Cool Virginia Steppers, and www.coolvirginiasteppers.com reserve the right to cancel at any time and without advance notice. Should an Event/Activity be canceled by Cool Ventures Entertainment, Cool Virginia Steppers, and www.coolvirginiasteppers.com, credit card transactions will be credited back to the original account from which the purchase(s) was/were made and cash payments will, at the discretion of Cool Ventures Entertainment, Cool Virginia Steppers, and www.coolvirginiasteppers.com, be refunded in either cash, check, or an exchange.
WAIVER OF RIGHTS/VALIDITY OF POLICY
I have read this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, PROMOTION, AND ADVERTISING POLICY and understand that I will be giving up substantial rights by accepting it and have accepted it freely without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid, the balance, notwithstanding, shall continue in full force and effect.
